1. Who we are

Moodcaster is a team mood tracking and OKR alignment platform operated by [COMPANY NAME UAB], a company registered in the Republic of Lithuania (company code: [COMPANY CODE]), hereinafter referred to as "Moodcaster", "we", "us", or "our".

By registering an account or using Moodcaster at moodcaster.app, you ("Manager", "Member", or "User") agree to be bound by these Terms & Conditions. If you do not agree, do not use the service.

2. The service

Moodcaster provides:

  • Anonymous team mood and energy check-ins
  • Manager dashboards with aggregated team atmosphere data
  • OKR (Objectives & Key Results) tracking for companies and individuals
  • AI-generated insights powered by Anthropic's Claude API
  • Email and (where available) Slack notifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Accounts and workspaces

Managers register a workspace and are responsible for all activity within it, including inviting members and managing data.

Members join a workspace via an invite link provided by their Manager. By joining, Members consent to their anonymous check-in data being visible in aggregated form to their Manager.

One subscription covers one workspace. Creating multiple workspaces to circumvent plan limits is prohibited and may result in account termination.

You are responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years old to create an account.

4. Subscriptions and payments

Free trial: All plans include a 14-day free trial. No credit card is required to start. After the trial period, continued access requires a paid subscription.

Monthly billing: Charged on the same date each month. You may cancel at any time and your access continues until the end of the current billing period. No refunds for partial months.

Annual billing: Charged once per year at the annual rate. Annual subscriptions are non-refundable. You may cancel before the renewal date to prevent the next charge. No partial refunds are provided for unused months within the annual period.

Price changes: We will give at least 30 days' notice before increasing subscription prices. Continued use after the notice period constitutes acceptance of the new price.

All prices are in Euros (€) and exclude VAT where applicable. VAT is added at checkout based on your country of residence in accordance with EU regulations.

Payments are processed by Stripe. We do not store your payment card details.

5. Plan limits and fair use

Each subscription plan includes defined limits on the number of workspace members and AI insight generations per day. These limits are enforced automatically.

AI insights are generated using a third-party AI API (Anthropic Claude). While higher-tier plans offer more generous daily limits, excessive automated or scripted use that places unreasonable load on our systems is prohibited and may result in temporary throttling or account suspension.

Downgrading your plan may restrict access to features (such as OKR tracking, which requires the Align plan or higher). Your data is preserved and becomes accessible again upon upgrading.

6. Data, privacy and anonymity

We take privacy seriously. Key principles:

  • Check-in anonymity: Individual check-in responses are anonymous by default. Managers see aggregated data, not individual attributions, unless a Member voluntarily provides their name.
  • OKR data: OKR objectives and key results are visible to the Manager and the assigned Member.
  • AI processing: Anonymised, aggregated check-in data may be sent to Anthropic's API to generate insights. No personally identifiable information is included in these requests.
  • Data retention: Check-in history is retained according to your plan tier (30 days to full history). Deleted workspaces are permanently removed after 30 days.
  • GDPR: We process personal data in accordance with the EU General Data Protection Regulation. You may request access to, correction of, or deletion of your personal data at any time by contacting us at privacy@moodcaster.app.

7. Acceptable use

You agree not to use Moodcaster to:

  • Harass, intimidate, or discriminate against employees based on their mood check-in data
  • Use check-in data as the sole basis for employment decisions, disciplinary action, or performance reviews
  • Attempt to de-anonymise or identify individual Member check-in responses
  • Reverse engineer, scrape, or attempt to access our systems beyond normal use
  • Resell or sublicense access to Moodcaster without written permission
  • Upload content that is illegal, harmful, or violates third-party rights

Violation of these terms may result in immediate account termination without refund.

8. Intellectual property

Moodcaster and its content, features, and functionality are owned by [COMPANY NAME UAB] and are protected by applicable intellectual property laws.

You retain ownership of data you input into Moodcaster. By using the service, you grant us a limited licence to process and store that data for the purpose of providing the service.

9. Limitation of liability

Moodcaster is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

To the maximum extent permitted by applicable law, [COMPANY NAME UAB] shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the service, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination

You may cancel your subscription at any time from your account settings or by contacting us at support@moodcaster.app.

We may suspend or terminate your account if you violate these terms, fail to pay, or if we discontinue the service. Upon termination, your right to access the service ceases immediately. We will retain your data for 30 days after termination, after which it is permanently deleted.

11. Governing law and disputes

These terms are governed by the laws of the Republic of Lithuania. Any disputes shall be resolved in the competent courts of Lithuania, unless mandatory consumer protection laws in your country of residence provide otherwise.

We encourage you to contact us first at support@moodcaster.app before initiating any formal proceedings — most issues can be resolved quickly.

12. Changes to these terms

We may update these terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
